Website Terms and Conditions

1. About Vitola BandWorks
Vitola BandWorks creates custom functional art featuring authentic cigar bands. It does not sell tobacco products and does not construct or install furniture. Base items are purchased or obtained separately and artistically transformed.
2. Eligibility and Acceptance
The website, Customer Portal, and commission services are intended for adults at least 18 years old who can enter a binding agreement. By using the website or portal, you agree to these Terms. A submitted inquiry does not guarantee acceptance; a commission is accepted only after written confirmation of its details, price, and payment requirements.
3. Custom and Handcrafted Nature
Every commission is individually created. Natural variations in cigar-band color, printing, age, placement, surface texture, photography, lighting, available materials, and finish are not necessarily defects. No two commissions are guaranteed to be exactly alike.
4. Customer Portal
Approved customers may view commission details, progress, photographs, payment requests, receipts, policies, and related information in the portal. Customers must protect credentials and may not access another customer’s account, the Founder’s Lounge, administrative pages, or other unauthorized records.
5. Payments and Stripe
Payments are securely processed through Stripe. A pending, declined, canceled, reversed, disputed, or failed transaction does not satisfy an obligation. Deposits, balances, due dates, cancellation, refunds, and fulfillment are governed by the applicable commission documents and policies.
6. Intellectual Property and Customer Materials
Vitola BandWorks branding, original copy, designs, photographs, and presentations may not be copied or commercially exploited without written permission. Customers retain ownership of original materials they submit and authorize their private use as reasonably necessary to evaluate and fulfill the commission. Public use requires the applicable release.
7. Honest Reviews and Acceptable Use
Vitola welcomes honest reviews, including unfavorable reviews. Users may not submit unlawful, fraudulent, threatening, defamatory, privacy-invasive, or malicious content; bypass security; probe systems; upload harmful code; impersonate others; or access unauthorized records.
8. Availability, Disclaimers, and Liability
The website and portal are provided on an available basis. Features may be corrected, maintained, restricted, or changed. To the fullest extent permitted by law, Vitola BandWorks is not liable for indirect, incidental, special, consequential, or punitive damages arising solely from website, portal, or third-party-link use. Rights that cannot legally be excluded remain unaffected.
9. Privacy, Electronic Communications, and Changes
Personal information is governed by the Privacy Policy. Customers consent to service-related electronic communications and may accept records through electronic checkboxes or signatures. Updated terms apply prospectively unless law requires otherwise; confirmed commission-specific terms will not be replaced without appropriate notice or agreement.
10. Governing Law and Contact
Maryland law governs these Terms. The parties will first make a good-faith effort to resolve disputes through direct written communication. Proceedings may be brought in a court serving Prince George’s County, Maryland, unless law requires otherwise. Questions: hello@vitolabandworks.com.
